Terms of Use

This End User License Agreement ("Agreement") is between you and Phillip Stuart ("Developer") and governs your use of the Pushi application ("App"). By downloading or using the App, you agree to these terms.

1. Acceptance of Terms

By accessing or using Pushi, you agree to be bound by this Agreement. If you do not agree, do not use the App.

2. License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions.

Personal use. Pushi Pro is licensed for personal, non-commercial use. You may create challenges for yourself, your friends, your family, and colleagues who choose to take part alongside you. You may not use Pushi Pro to run a challenge organised by, or on behalf of, an employer, business, club, school, or other organisation — including any challenge forming part of a workplace wellbeing, HR, or employee engagement programme. Organisations wishing to run challenges for their members must use Pushi for Organisations (see section 6), which provides the administrative controls, invoicing, and data protection arrangements that organisational use requires.

3. Subscription — Pushi Pro

Pushi offers an optional auto-renewing subscription ("Pushi Pro") that unlocks additional challenge modes, increased participant limits, and longer challenge durations.

• Pushi Pro Yearly: €12.99 / $11.99 per year (varies by region)
• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time through your Apple ID Account Settings.
• Any unused portion of a free trial is forfeited upon purchasing a subscription.

4. Free Features

The App provides core functionality at no cost. A subscription is not required to use the basic features of Pushi.

5. Health Data

Pushi integrates with Apple HealthKit to read activity and fitness data from your device. This data is used to calculate challenge scores, display leaderboards, and — where you have connected with a friend and agreed to share — show a summary of your daily progress on the friend board (see section 7). Pushi does not write data to HealthKit. Health data is never sold or shared with third parties for advertising purposes. For full details on how we handle your health data, see our Privacy Policy.

6. Organisation Challenges

You may join organisation challenges through the App using your organisation's email domain. When you join an organisation, your scores and accumulated totals within challenges are visible on the leaderboard to all other participants in that challenge, and to the organisation's administrators. You will be shown a clear notice explaining this before you complete joining.

Joining an organisation is voluntary. You can leave at any time through the App, which will end the organisation's access to your future challenge data. Your personal account, health data, and activity outside of organisation challenges remains private.

7. Friends and Connections

The App lets you connect with other Pushi users. Where you connect and both agree to share, each of you can see a weekly friend board showing the other's progress against their own daily activity goal: how many days they have reached this week, whether they have reached today's goal, how far through it they are as a proportion, and their current streak. No underlying health figures are shared — not step counts, calories, exercise minutes, distances, heart rate, or workout details.

Before you connect, you are shown a notice setting out exactly what is and is not shared, and you confirm it as part of connecting. You may hide an individual connection from your board, or turn sharing off altogether with the Share my daily results switch on the Friends & Ladder screen, at any time. 8. User Accounts

You may be required to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@pushi.fitness if you suspect unauthorised use of your account.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful or fraudulent purpose.
• Reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App or its servers.
• Impersonate any person or entity.
• Submit false or misleading activity data to gain an unfair advantage in challenges.

10. Intellectual Property

The App and all its content, features, and functionality are owned by the Developer and are protected by copyright, trademark, and other intellectual property laws. Nothing in this Agreement grants you any right to use our trademarks or branding without our express written permission.

11. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind. The Developer does not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Pushi is not a medical device and should not be used as a substitute for professional medical advice. Consult a qualified medical professional before starting any new fitness programme, particularly if you have pre-existing health conditions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. The Developer's total liability to you shall not exceed the amount you paid (if any) for the App in the twelve months preceding the claim.

13. Termination

The Developer may terminate or suspend your access to the App at any time, without notice, for conduct that violates this Agreement or is otherwise harmful to other users or the App.

14. Changes to This Agreement

The Developer reserves the right to modify this Agreement at any time. Changes will be posted on this page with an updated date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Agreement.

15. Apple's Role

This Agreement is between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support for the App. To the extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims relating to the App or your use of it.

16. Governing Law

This Agreement is governed by the laws of Austria. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Vienna, Austria.
